Please read these terms and conditions of sale carefully before placing any orders.

§ 1 Scope of application

These general terms and conditions (GTC) apply to all contracts concluded via our online shop between us,

(hereinafter referred to as "we", "us" or "provider") and you as our customer (hereinafter referred to as "you" or "customer") in the respective valid version.

These GTC distinguish between:

• consumers within the meaning of § 13 of the German Civil Code (natural persons acting for private purposes),
• entrepreneurs within the meaning of § 14 of the German Civil Code (legal or natural persons acting in the exercise of their commercial or self-employed professional activity).

Provisions that apply exclusively to entrepreneurs (B2B) are explicitly identified as such.

Our GTC apply exclusively. Any deviating, conflicting or supplementary general terms and conditions of the customer shall only become part of the contract if we have expressly agreed to their validity. This requirement for consent shall apply in every case, for example even if the customer refers to his general terms and conditions in the context of the order and we do not expressly object to this.

§ 2 Eligibility to order and conclusion of contract

The presentation and promotion of our products does not constitute a binding offer to conclude a purchase contract, but an invitation to submit a purchase offer by the customer.

To place an order, you must be at least sixteen (16) years of age or have reached the minimum legal age required under the laws applicable to you to enter into a legally binding contract.

By submitting an order via the online shop by clicking the "[Buy now]" button, you are placing a legally binding order. Your statutory right of withdrawal remains unaffected.

We will confirm receipt of your order submitted via our online shop by e-mail without delay. Such an email does not constitute a binding acceptance of the order unless it also includes a declaration of acceptance in addition to the confirmation of receipt.

A contract is only concluded when we accept your order by means of an order confirmation or by delivering the ordered products.

All orders received via our online shop are subject to product availability. We also reserve the right to refuse orders for any reason.

We are also entitled to terminate an already concluded contract by written notice without being liable for any damages or costs beyond the reimbursement of any payments already made. Such termination may occur in particular if:

• the billing information you provided is incorrect or unverifiable,
• your order is flagged as unusual or suspicious by our security systems,
• you are under sixteen (16) years of age or below the minimum legal age for contracting in your jurisdiction,
• the price stated in the online shop was obviously incorrect,
• delivery to the address you provided is not possible, or
• performance of the contract is impossible due to an event beyond our control. This includes, but is not limited to, strikes, lockouts or other third-party interference in production, civil unrest, uprisings, invasions, terrorist attacks or threats thereof, war, whether declared or undeclared, as well as preparation for war, fire, explosions, storms, floods, earthquakes, subsidence, epidemics, pandemics, other natural disasters, and the failure of public or private telecommunications networks.

Purchasing goods through our online shop for the purpose of resale is not permitted without our prior express consent. Resale is deemed to exist, in particular, if the purchased products are resold in any form to third parties (including consumers, commercial enterprises or other third parties) or intended for such resale. In case of justified suspicion of unauthorized purchasing for resale, we reserve the right to take appropriate measures. These include, in particular, limiting the purchase volume, canceling orders already placed and suspending or deleting your customer account.

§ 3 Delivery conditions and reservation of advance payment

Goods are generally shipped by post.

We are entitled to make partial deliveries, provided this is reasonable for you.

Standard delivery times are generally between one and fourteen (14) business days, depending on the destination, unless otherwise agreed. These times apply once the product is in stock and typically begin upon conclusion of the contract. This information is only a non-binding estimate and the schedule is not binding.

For orders from customers residing or established abroad or where there is a legitimate indication of payment default risk, we reserve the right to deliver only after receipt of the purchase price plus shipping costs (advance payment reservation). If we exercise the right of advance payment, we will inform you immediately. In this case, the delivery period begins upon payment of the purchase price and shipping costs.

If the ordering customer is a business, the risk of accidental loss transfers to them upon delivery to the shipping company (§ 447 BGB).

§ 4 Prices and shipping costs

Prices are generally stated in euros and are gross prices including all applicable taxes.

If you change the destination country for shipping during your visit to our website or during the payment process, prices may subsequently be displayed in a different currency. Please note that changing the destination country may affect the total price due to currency or pricing adjustments.

The total price relevant to your order, including any taxes and shipping costs, will be specified in the order confirmation, which you should save or print for reference.

If we fulfill your order in partial deliveries, you will only be charged shipping costs for the first delivery. If partial deliveries are made at your request, we will charge shipping costs for each partial delivery.

§ 5 Terms of payment, set-off and right of retention

Accepted payment methods are listed on our website. Other payment methods not listed will not be accepted. Please refrain from paying in any other way. We shall not be liable for any payment failures or damages arising therefrom.

If you pay by credit card, the total amount for the entire order will be shown on your credit card statement in your local currency. If your local currency differs from the currency in which the prices are quoted, your bank will apply the conversion rate valid on the date of purchase. Your bank may use a different exchange rate, which is beyond our control.

For payments by credit card or EC/Maestro card, your account will usually be charged when the goods leave our warehouse. In case of bank transfer, your order will be processed or shipped once we have received the full payment. This may take several days depending on the bank processing times.

If payment is not received within fourteen (14) calendar days of your order, we reserve the right to cancel your order automatically.

You may only set off claims that are undisputed or legally established. The same applies to rights of retention, provided they arise from the same contractual relationship.

§ 6 Retention of title

The delivered goods remain our property until full payment has been received.

If the customer is a business, the retention of title extends to other claims that the provider has against this customer from their business relationship.

§ 7 Warranty and liability

The statutory warranty provisions apply.

For goods with digital elements or other digital content, we owe provision. Updates to digital content are only owed to the extent expressly agreed as part of a specification agreement pursuant to paragraph 2. We accept no liability for public statements made by manufacturers or other third parties.

Any applicable warranty conditions can be found in the respective product description or accompanying documents.

In cases of intent or gross negligence, we shall be liable without limitation under the statutory provisions.

In cases of simple negligence, we shall only be liable for breach of essential contractual obligations (cardinal obligations) and only for the typical, foreseeable damage.

Any mandatory strict liability, e.g. under the Product Liability Act, as well as liability for damages resulting from injury to life, body or health remains unaffected.

For customers who are businesses, it applies, in deviation from paragraphs 1 and 4, that the provider excludes liability regardless of the legal basis of the asserted claim, unless a warranty has been provided for the condition of the goods (see para. 2) or a defect was fraudulently concealed.

§ 8 Copyright

All rights to images, texts and videos in the online shop are held by us. Use without our prior express written consent is not permitted.

§ 9 Data protection notice

We process your personal data for the purpose of fulfilling our contractual relationship in accordance with the GDPR. Further information can be found in our Privacy Policy.

§ 10 Applicable law and jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory applicable law of the country of your habitual residence remains unaffected.

If the customer is a merchant within the meaning of § 1 of the German Commercial Code (HGB), the place of jurisdiction shall be the seller's registered office. Otherwise, the statutory jurisdictions apply.

We are not willing to participate in dispute resolution proceedings before a consumer arbitration board.

Right of withdrawal
